Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and Bobble Designs ("Bobble", "we", "us", or "our") governing your access to and use of the Bobble web application, website, and related services (collectively, the "Service") available at bobbledesigns.com.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Description of the Service

Bobble is a web-based application that enables users to convert photographs and images into crochet charts, complete with colour palettes and row-by-row stitch instructions. The Service is available as a free tier with limited functionality and as a paid subscription ("Bobble Pro") with additional features.

2. Eligibility

You must be at least 16 years of age to create an account or use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under the age of 18, you confirm that you have the consent of a parent or legal guardian.

3. Account Registration and Security

3.1 Account Creation

You may use certain features of the Service without an account (local-only mode). To access cloud features, you must sign in using a Google account. We do not offer username/password registration.

3.2 Account Security

You are solely responsible for maintaining the confidentiality and security of your Google account credentials. You agree to notify us immediately of any unauthorised access to or use of your account. We shall not be liable for any loss or damage arising from your failure to safeguard your account.

4. Subscription Plans and Payment

4.1 Free Plan

The free plan provides access to core features with the following limitations:

• Up to 2 projects, stored locally in your browser
• No cloud synchronisation or cross-device access

4.2 Bobble Pro

Bobble Pro is a paid subscription that provides:

• Up to 50 projects with cloud storage and synchronisation
• Access from any device
• PDF and image export capabilities

4.3 Pricing and Billing

• Bobble Pro is priced at £3.99 per month, billed monthly
• All payments are processed securely by Stripe, Inc.
• Prices are inclusive of applicable taxes unless otherwise stated
• We reserve the right to modify pricing upon 30 days' written notice to active subscribers

4.4 Cancellation

You may cancel your Bobble Pro subscription at any time through the Account settings page. Upon cancellation:

• Your Pro features remain available until the end of the current billing period
• No further charges will be applied
• Your cloud-stored projects will remain accessible in read-only mode for 30 days, after which they may be deleted

4.5 Refunds

Refund requests are handled on a case-by-case basis at our reasonable discretion. To request a refund, please contact us at hello@bobbledesigns.com within 14 days of the charge in question.

5. Intellectual Property

5.1 Your Content

You retain all ownership rights in any images you upload and charts you create using the Service ("User Content"). We do not claim any intellectual property rights over your User Content.

5.2 Licence to Bobble

By using cloud synchronisation features, you grant us a limited, non-exclusive, royalty-free licence to store, reproduce, and transmit your User Content solely for the purpose of providing and operating the Service. This licence terminates when you delete your content or your account.

5.3 Our Intellectual Property

The Service, including its design, code, graphics, logos, and trademarks, is owned by Bobble Designs and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation
• Upload content that infringes the intellectual property rights of any third party
• Upload malicious code, viruses, or any harmful digital content
• Attempt to gain unauthorised access to the Service, its servers, or related systems
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service as general-purpose file storage unrelated to its intended function
• Resell, sublicence, or redistribute the Service or access thereto without our prior written consent
• Use automated means (bots, scrapers, etc.) to access the Service without our prior written permission

7. Service Limits

• Free accounts: up to 2 projects (stored locally in your browser)
• Pro accounts: up to 50 projects (stored in the cloud)
• Maximum data size: 5 MB per project

We reserve the right to modify these limits with reasonable notice. Usage significantly exceeding normal patterns may be subject to throttling or suspension pending review.

8. Service Availability

We endeavour to maintain the availability of the Service at all times; however, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

• Scheduled or emergency maintenance
• Updates, upgrades, or infrastructure changes
• Circumstances beyond our reasonable control (force majeure)

The offline-capable PWA functionality will continue to operate for locally stored projects regardless of server availability.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Service will meet your specific requirements, that the results obtained from using the Service will be accurate or reliable, or that any defects in the Service will be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses
• Our total aggregate liability arising out of or in connection with these Terms or your use of the Service shall not exceed the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim
• For free-tier users who have made no payments, our total aggregate liability shall not exceed £50

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bobble Designs and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your breach of these Terms.

12. Account Termination

12.1 Termination by You

You may delete your account at any time via the Account settings page. Upon deletion, all your projects, personal data, and account information will be permanently removed from our servers.

12.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service, without prior notice or liability, if:

• You breach any provision of these Terms
• Your use of the Service poses a security risk or may cause harm to other users
• We are required to do so by law

13. Modifications to the Service and Terms

13.1 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

13.2 Amendments to Terms

We may revise these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. For material changes, we will make reasonable efforts to provide notice via the email address associated with your account at least 14 days before the changes take effect.

Your continued use of the Service following the posting of revised Terms constitutes your acceptance of such revisions. If you do not agree to the revised Terms, you must stop using the Service.

14. General Provisions

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jersey (Channel Islands), without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any disputes arising out of or in connection with these Terms shall first be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of Jersey.

14.3 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

14.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bobble Designs with respect to the Service and supersede all prior agreements, understandings, and communications.

14.5 Waiver

The failure of Bobble Designs to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

14.6 Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction.
